4 Constitution, Rules & Playing Conditions 59  7.12.4.4  Any combination of the above.  7.12.5  Where any player has been found guilty of disciplinary offences in the  same season on two or more occasions an additional ban from playing of  a further 2 weeks shall be imposed upon that player at each separate  subsequent disciplinary hearing in addition to any penalties imposed by  the Disciplinary Sub‐Committee on each occasion.  In such  circumstances, the player’s club shall be fined a sum not exceeding  £50.00.  7.13 Further Information  7.13.1 The conduct listed in Levels 1 to 4 above cannot be considered to be  exhaustive.  Where any alleged breach falls outside the conduct above,  whether on or off the field, the disciplinary committee shall determine the  appropriate Level with reference to the following factors:  7.13.1.1  The level of harm potentially caused to the interests or reputation of the  League or the game of cricket in general.  7.13.1.2  Whether any alleged language used or gesture made which may offend,  insult, humiliate, intimidate, disparage, threaten or vilify another person  on the basis of that person’s (or that person’s perceived) age, race,  religion, sexual orientation, colour, descent or national or ethnic origins.  7.13.1.3  Whether it is alleged that any conduct was intended to cause physical  harm to another person, or such harm was foreseeable.  7.13.1.4  Whether the alleged behaviour breached the Child Protection Code.  7.13.1.5  Any other factor relevant to the particular circumstances of the alleged  behaviour.  7.13.2 In addition, where a Club, individual or their representative and witnesses  behave inappropriately or fail to respect the formality at any level of hearing,  the Disciplinary and Appeals Sub‐Committees reserve the right to impose  further corrective actions or penalties as they see fit.  7.13.3 Decisions of the Disciplinary Sub‐Committee (a finding that a complaint is  proved or not proved or a decision or penalty) shall be by majority vote; where  necessary the Panel Chair shall have a casting vote.  7.14 Appeals Procedure  7.15.1 A player or club found guilty of a Disciplinary offence will have the right of  appeal to the Appeals Sub‐Committee.  Notice of Appeal stating whether the  appeal is against the finding, or is against the penalties imposed, and setting  out the grounds must be given in writing to the League Secretary within seven  days of the decision of the Disciplinary Sub‐Committee, together with a  deposit of £50.00.  7.15.2 If Notice of Appeal is given the penalty shall not take effect pending the  hearing of the Appeal.
