6.5.1 To require the Club to submit appropriate letter(s) of apology within a specified time. The Club’s failure to comply with such requirement shall be deemed to be conduct leading to a further complaint. 6.5.2 To record a reprimand and to give warning as to future conduct. 6.5.3 To impose a fine. 6.5.4 To deduct League points from the Club’s team(s). 6.5.5 To relegate to any lower division of the League or to the Cheshire Cricket Alliance. 6.5.6 To expel the Club from any competition of the League. 6.6 The Committee will take the following factors into account when determining the penalties to be imposed :- a. If the accused player/Club has pleaded guilty. In all cases and for all offences, an admission of guilt will almost certainly in a lesser sentence being imposed than if the matter is contested – credit being given for the admission. Plainly, the extent of the credit to be given will depend upon all the circumstances of the case, including how early the admission of guilt is made, but, save possibly in the most trivial of cases, it will not normally be such as to change the nature of the penalty or to bring about total suspension of the penalty. b. The player’s previous Disciplinary record c. If the player is also the Captain d. The conduct of the player subsequent to him being warned and told that a report would be made e. If an Appeal is considered to be spurious 6.7 The Committee shall have the power to suspend the operation of any part, or all, of the penalty it imposes for such period and subject to such terms and conditions as it deems appropriate. 6.8 Suspensions will be imposed in weeks (7 days), commencing midnight Friday to midnight Friday and will normally apply to all matches played under the auspices of ECB during that time. 6.9 Decisions of the Committee (a finding that a complaint is proved or not proved or a decision on penalty) shall be by majority vote; where necessary the Chairman of the Committee shall have a casting vote. 6.10 The decision of the Committee shall be confirmed in writing to the club or the player (and his Club) as appropriate as soon as reasonably practicable. 7. Appeals Procedure 7.1 A player or Club shall have the right of appeal to the Appeals Sub- Committee (the Appeals Committee). Notice of Appeal setting out the grounds must be given in writing to the Secretary to the Appeals Committee within seven days of the decision of the Disciplinary Committee being communicated to the relevant player or Club as required by subparagraph 5.6, together with a deposit of £10. 7.2 If a Notice of Appeal is given no penalty or penalties imposed by the Committee to which the Notice shall relate shall take effect pending the hearing of any such Appeal, which shall take place as soon as practicable. 7.3 The Appeal shall be by way of re-hearing before the Appeals Committee. 117
